Johnson nominated Van Dusen for elevation to a seat on the United States Court of Appeals for the Third Circuit vacated by James Cullen Ganey. Van Dusen was confirmed by the United States Senate on June 12, 1967, and received his commission the same day, and vacated his District Court seat on June 26, 1967.
