Johnson nominated Carter for elevation to a seat on the United States Court of Appeals for the Ninth Circuit vacated by Gilbert H. Jertberg. Carter was confirmed by the United States Senate on November 16, 1967, and received his commission the same day. He assumed senior status on September 30, 1971.
