Grant appointed McKinney (through a recess appointment) to the United States District Court for the Southern District of Florida on November 8, 1870, to the seat vacated by Thomas Jefferson Boynton. McKinney was nominated on December 7, 1870. Confirmed by the Senate on February 18, 1871. He received commission on February 18, 1871. McKinney served on the court until his death in 1871.. }
