He was the United States Attorney for the Northern District of West Virginia from 1961 to 1964. On July 19, 1965, Maxwell was nominated by President Lyndon B. Johnson to a seat on the United States District Court for the Northern District of West Virginia vacated by Charles F. Paul. Maxwell was confirmed by the United States Senate on August 11, 1965, and received his commission the same day.
