It was to be part of their much larger, 8-acre spread near Molasses Creek, where they hoped to build a home. Ownership of the cemetery was transferred from Dorothy Rausch Ayres, a local who bought land in the area in 1953, to Remley's Point Development LLC, and then to the Rogers. On November 13, 2001, residents of Scanlonville sued the Rogers in an effort to have a community graveyard recognized on the property, and the Rogers withdrew their request for permission to relocate the graves that was pending with Town Council. On November 12, 2002, Mt. Pleasant officials deferred a renewed request to allow the moving of graves at the African-American. The deferral came nearly a year to the date that the same couple withdrew virtually the same request to Town Council for permission to move graves on part of the 10-acre property they contended they owned.Residents said the graveyard may have up to 1,000 people buried in it, including some whites, and that it pre-dates the 1870 establishment of Scanlonville, a community created for freed slaves after the Civil War. Most of the graves are unmarked. The lawsuit sought the state court's recognition of Scanlonville Graveyard as a commonly owned property, to give descendants the right to maintain the property as a functioning graveyard, and to block development of the land. The Rogers and their attorneys said the graveyard is "abandoned" and that they own the land.Following the first effort to get permission for the move, state officials recommendeded that the cemetery be added the National Register of Historic Places. South Carolina state law requires the local jurisdiction's approval before moving graves can take place, if officials deem it "necessary and expedient."A lawsuit was filed to determine the ownership of the land. In a ruling hailed as a victory for black culture and traditions, a judge said that the cemetery was in the public domain and can't be developed. Scanlonville Cemetery near Remley's Point might not have been as manicured as others, but the judge noted that it has a history dating back 130 years and never was formally abandoned.".
