- 01GVF13FVX31WQBBFDCDTVNEAJ abstract "In response to unprecedented global biodiversity loss, restoration obligations have been integrated into international and Chinese legal frameworks. At the international level, this thesis discusses restoration under the UNFCCC, the UNCCD, and the CBD. In particular, the thesis focuses on the CBD, the most landmark international restoration framework. As a Party to the CBD since 1992, China has implemented international restoration obligations into governmental and individual restoration obligations at the domestic level. When using legal litigation to force them to undertake restoration obligations, China faces a lack of enough qualified plaintiffs against the government. Under the public trust principle, citizens can sue the government, when the government fails to fulfil its fiduciary obligations. Although there is no explicit reference to the public trust in China, like-public trust languages have been included in the current Chinese laws. This thesis answers the question whether the public trust can be used to advance ecological restoration in China.".
