De aantasting van een overeenkomst door een nietigheidsgrond wordt er bestudeerd vanuit de drie “wegen” waarlangs deze in een procedure aan bod kan komen: 1) een procespartij stelt een (tegen)vordering tot nietigverklaring in, 2) een procespartij werpt de exceptie van nietigheid op of 3) de rechter werpt de nietigheidsgrond ambtshalve op. Zowel op het vlak van het toepassingsgebied, de gevolgen als de verjaring bleek een afzonderlijke behandeling van de drie wegen van belang. Deze nieuwe benadering laat tevens toe duidelijk de verschillen te zien met een automatisch werkende (absolute) nietigheid die in vele Europese rechtsstelsels gangbaar is.".
