Barber also felt that Mizell was a carpetbagger who was betraying his state by siding with the Republicans, and was not happy about paying taxes to support the Reconstruction government.In February 1870, it is assumed that Barber was camping in Brevard's Jane Green Swamp where Mizell was traveling with official documents when the sheriff was shot and killed. The sheriff's brother judge John Mizell, formed a posse to track down the suspected murderers with orders to shot first and ask questions later.It is not certain if Mose Barber lived through the conflict, but forty-one men were killed as a result of the feud. Only ten defendants came to trial; but none were convicted. In the course of the proceedings, a western Brevard County courthouse was burned to the ground.".
