- catalog abstract "On April 25, 1940, the case of Minersville School District et. al. v. Gobitis et. al., 310 U.S. 586, was argued before the Supreme Court of the United States on certiorari to the Circuit Court of Appeals for the Third Circuit. The lower courts had held it unconstitutional to expel from the public schools of Minersville, Pennsylvania, two children who, for religious reasons, refused to salute the national flag. On June 3, 1940, the Supreme Court reversed the decisions of the lower court and sustained the expulsion, Mr. Justice Frankfurter writing the opinion. Professor George K. Gardner of the Harvard Law School was counsel for the children. The day after his argument before the Court, his students presented him with the flag preserved in this folder. The Minersville decision was reversed in 1943 in West Virginia State Board of Education v. Barnette, 319 U.S. 624.".
